A DBA is referred to as Fictitious Name Registration in the State of Florida. The form is not filed with individual county clerks but with the Division of Corporations, which is a state governmental entity. In Florida, the purpose of business name registration is to provide the public with notice of ownership of the business. If you are using your own legal name - both first and last name - in your business name, then you do not have to register. Registering your business name through a DBA filing in the Sunshine State does not reserve that name exclusively, and it may be used by others in future registrations. However, even if using your own personal name, it's always a good idea to undertake a name search to find out how many businesses may already be registered using your chosen name.
With some exceptions, registration may be accomplished by electronic filing. However, cancellations, cancellation re-registrations and fictitious name renewals may not be filed electronically. Your fictitious business name, valid for a period of five years, expires on December 31st of the fifth year. You can renew your Fictitious Name Registration, but it must be done between July 1 and December 31 of the expiration year to keep your registration current. If you sell the business, you as the owner of record must file a cancellation and re-registration form within 30 days of the change. You must present proof of your business name registration before you can obtain a local operating license, but you are not required to publish notice in a newspaper.
